By entering the “100% Appliances” Website, you acknowledge that you have read, understood and agreed with the following terms and conditions of use. Appliance Connexion Limited (“ACL”) reserves the right to modify these terms and conditions as and when necessary.
All documents, visuals, animations and graphics contained in the “100% Appliances” website are the property of Appliance Connexion Limited.
The “100% Appliances” Website is protected by copyright. You may print out documents or pages for your individual/Company use, but no unauthorised distribution or making available to the public (whether in print or electronic form) of any data contained within this Website is permitted without prior consent from ACL.
The right to edit or delete any documents, information or other content appearing on the Website is at the discretion of ACL.
The "100% Appliances" Website may contain links to other websites. ACL is not responsible for the content, accuracy or opinions expressed in such websites, and such websites are not investigated, monitored or checked for accuracy or completeness by ACL. Inclusion of any linked website on "100% Appliances" Website does not imply approval or endorsement of the linked website. If you decide to leave the "100% Appliances" Website and access third party sites, you do so at your own risk.

This website is owned and operated by Appliance Connexion Limited. However, Appliance Connexion Limited does not supply any of the goods offered for sale on this website.
All goods bought through this website are sold by 100% Barrells Extreme Appliances. Appliance Connexion Limited provides this website only as a market place where buyers can view stock held by 100% Appliance stores, shop online for goods from 100% Barrells Extreme Appliances or find their local 100% Appliances store. All payments made for goods through this website are passed on to 100% Barrells Extreme Appliances. Appliance Connexion Limited does not act as an agent for 100% Barrells Extreme Appliances or for any 100% Appliances store and accepts no claim or liability for goods purchased through this website or from any 100% Appliances store. All issues relating to an online purchase must be directed to 100% Barrells Extreme Appliances or where purchased from a 100% Appliances store, to the store that supplied the goods, in the first instance. However, Appliance Connexion does provide a dispute process. See the section on disputes, below.

While we endeavour to supply accurate information on this site, errors and omissions may occur. Where allowed by law, Appliance Connexion Limited does not accept any liability, direct or indirect, for any loss or damage which may directly or indirectly result from any advice, opinion, information, representation or omission whether negligent or otherwise, contained on this site. You are solely responsible for the actions you take in reliance on the content on, or accessed, through this site.
Appliance Connexion Limited reserves the right to make changes to the content on this site and these terms and conditions at any time and without notice.
We will use reasonable endeavours to ensure that the website operates reliability and consistently, but we do not guarantee or provide any warranties that the website will operate uninterrupted without any faults.
We are not responsible for any losses suffered by you or any third parties (including direct, special, indirect, consequential, loss of profits, exemplary or otherwise) arising out of your access to the website, interruption or unavailability of the website, system outages or malfunctions, however caused. This includes viruses alleged to have been obtained from the service, your use of or reliance on the service or any of the information or materials available on the service, regardless of the type of claim or the nature of the cause of action.
Access to this website may be terminated at any time by us without notice. Our disclaimer will nevertheless survive any such termination.

If you choose to create an account, access to your account is by your designated username and password. You may change your password at any time. If you forget your password, we will send you an email containing a new password.

If we have reason to believe that there is likely to be a breach of security, misuse of the website or any unlawful activity, we may suspend and/or terminate your account without notice.

5) Placing an Order
When you place an order through this website, you are buying the goods from 100% Barrells Extreme Appliances and not from Appliance Connexion.
We will send you an e-mail to confirm that we have received your order. Payment for the goods must be made at the time that you place your order. In the event that the goods are no longer available, you will be advised and your payment will be refunded in full.
An order is made on our website by placing a product in your shopping cart and proceeding through our checkout process which includes delivery, billing and any other relevant details.
The final step consists of a confirmation page with full details of your order, which you are able to print as a record of your order. We will also email you with confirmation of your order.
We reserve the right to refuse or cancel any orders that we believe, solely by our own judgement, to have been placed fraudulently or where there has been an error in the listing, description or pricing of the goods.

All prices listed on 100% Appliances website are in New Zealand dollars and are inclusive of GST. While we endeavour to ensure that all prices are correct when published, we reserve the right to amend the prices where an error has occurred.
Also note, these prices listed are available online only as pricing may vary in-store.
While we endeavour to ensure that a reasonable number of goods are available at the prices stated, we cannot guarantee that there will be sufficient stock to meet all orders.
7b) Prices and Savings Advertised on this Website
Prices and savings advertised on this 100% Appliances website are for online ordering on this website only. Consequently, prices and savings may vary in 100% Appliances stores and on individual member websites. To check relative prices please feel free to call or email your local 100% Appliances store.
7c) Website Content
We endeavour to provide the most accurate and up to date content where possible on this website, but advise that at any time our suppliers can change or update content and it is recommended that you refer to the product specification manuals that come with the product for the latest information.
8) Website and Credit Card Security
We want you to have a safe and secure shopping experience online. All payments via our sites are processed via the secure DPS payment gateway which secures your credit card information.
9) Delivery and Delivery Charges for Online Purchases
Your goods will be supplied by 100% Barrells Extreme Appliances and will be delivered by it, in accordance with your instructions given when you placed your order. You can change your delivery instructions at any time by contacting 100% Barrells Extreme Appliances and quoting your order number. 100% Barrells Extreme Appliances will be able to advise you on what, if any, additional charges will apply. Due to Health and Safety, extra charges may also apply if delivering the appliance requires extra personnel because of oversized or heavy items, or where access is difficult due to stairs etc. The supplier name that will appear on your statement will be 100% Barrells Extreme Appliances.

At this time, we only deliver to New Zealand addresses excluding P O Boxes and Private Bags.
Our standard online order delivery service is "drop off in box only" and does not include installation.
Please note that a signature is required for all deliveries. The goods become the recipient’s property and responsibility once they have been signed for at the time of delivery. If goods are lost or damaged in transit, please contact us within 7 business days at service@100percent.co.nz
10) Delivery Period
100% Barrells Extreme Appliances will endeavour to ensure that the majority of appliance orders will be available for dispatch within 3-5 business days of the order being placed, however beds and furniture may take 2-4 weeks to manufacture and deliver. 100% accept no liability for any unforeseen delays in delivery. Note: All online sales attract a freight only delivery charge. Please contact your nearest 100% store to discuss installation and set-up options.
To ensure successful delivery, please provide a delivery address where someone will be present during business hours to sign for the receipt of your goods.

11) Returns and Refunds
If you are shopping in one of our 100% Appliances stores, we would endeavour to assist you to purchase the correct appliance for your new home by asking you the right questions. However, this is not as easy when you order online. If you need help or have questions about any products please contact us first, before you purchase online.
If you do purchase online and want to return the product you purchased, please note that there is no legal requirement for 100% Barrells Extreme Appliances to accept returned goods if you have merely changed your mind. However, 100% Barrells Extreme Appliances may accept certain goods back if they are returned unopened, unused and in original undamaged condition within a period of 7 days only. Contact 100% Barrells Extreme Appliances first to see if this applies to the goods that you wish to return.
Unfortunately, software, personal hygiene products and headphones may only be returned if they are faulty. They cannot be returned simply because you have changed your mind about them.
You are also entitled to all guarantees and rights to return faulty goods that may be given by the manufacturer of the goods and by law except where excluded in these terms and conditions.

12) Exclusions to the Fair Trading Act 1986 and Consumer Guarantees Act 1993
Where you are in trade, you agree it is fair and reasonable that the following provisions of the Fair Trading Act are excluded:
- Section 9 which prohibits misleading and deceptive conduct generally;
- Section 12A which prohibits unsubstantiated representations; and
- Section 13 which prohibits false or misleading representations.
The guarantees under the Consumer Guarantees Act 1993 are excluded for all purchases of goods made for business purposes. However any manufacturer’s warranty and the Sale of Goods Act 1908 will continue to apply.

100% Appliances owns all copyright and other intellectual property in this site. Everything on this site, unless otherwise stated, is copyright.
100% Appliances welcomes the use of this site for personal use, non-commercial use, research or study - provided that the user acknowledges all copyright and other notices contained in the content.
We advise that you may not copy or display for redistribution to third parties or for commercial purposes, any portion of this site without the express permission of 100% Appliances.
You must ensure that your access to this website is not illegal or prohibited by the laws in the country in which you access the website and does not infringe the intellectual property rights (copyright, trademark, brand etc) of any third parties. You must take your own precautions to ensure that the process which you employ for accessing the website does not expose you to the risk of viruses, malicious computer code or other forms of interference which may damage your own computer system.

15) Security and Confidentiality
When transmitting and dealing with your personal information over the Internet, you acknowledge that the Internet is not a secure environment. Although we have physical, electronic and managerial processes in place to protect our website and the information we collect via our website or email, we cannot guarantee that your information will be secure, confidential and free from unauthorised access or security breaches. Accordingly, you acknowledge and agree that we are not liable for any unauthorised access damage or loss that may occur or for correcting or restoring your account which may have been damaged by reason of the unauthorised access.
16) Disputes
Where you have a dispute with 100% Barrells Extreme Appliances over goods purchased from it through this website and it has not been resolved to your satisfaction, you may ask Appliance Connexion Limited to investigate provided no more than 3 months has passed since your purchase. Appliance Connexion will attempt to mediate between you and 100% Barrells Extreme Appliances in a fair and honest manner. However, it does not provide any assurance that it will provide you with any particular outcome nor shall it be liable to you for any costs that you may incur during the process.
You are also entitled to withdraw your dispute at any time and to use any other complaint process that you may wish.
17) Jurisdiction
This website is governed by, and is to be interpreted in accordance with, the laws of New Zealand.
18) Privacy
Your privacy is important to us and we will take all reasonable steps to ensure that information held is secure in accordance with our Privacy Policy.
Customer information is shared with 100% Barrells Extreme Appliances and as necessary to provide the services offered through this website.
Our website uses a checkout page with security measures to process your private payment details. We use DPS to process credit card payments.

21) Severability
If any part of these terms is held to be invalid, illegal or unenforceable, that part will be severed and the remainder of these terms will remain in full force and have full effect.

It is your responsibility to ensure that you keep us informed of any changes to your contact details. You will be deemed to have received a notice sent by email at the time that we send it.

These terms (including any terms or policies explicitly incorporated by reference) amounts to the whole of the arrangement between you and us relating to your use of the website or our services. These terms replace any prior related agreements and understandings between you and us.
