Privacy Policy

1) APPLICATION

100% Home (referred to as “we” “our” or “us”) is committed to protecting the privacy of your personal information (as defined in the Privacy Act 2020 or any successor legislation) (“Privacy Act”)). 

The purpose of this Privacy Policy is to inform you how we manage your personal information, including the collection, use, storage and disclosure of such information and your rights to access and correct information held. 

This Privacy Policy applies to all personal information collected via the 100% Home website (100percent.co.nz) (“Website”), which is owned and operated by Home Group Services Limited (“HGS”) on behalf of all 100% stores, and all personal information collected via our store or any of the other 100% stores within the HGS Group of companies, its affiliates, subsidiaries or related companies (“100% Group”). This Privacy Policy does not apply to any personal information you disclose to a third party, including where our Website directs you to a third party website, and we encourage you to review the applicable third party’s privacy terms before disclosing your information. 

By continuing to use our Website, or entering any of our 100% Group stores, you acknowledge that you have read and understood this Privacy Policy and unconditionally consent to us dealing with your personal information in the manner set out in this Privacy Policy (as amended from time to time). 

This Privacy Policy is governed by New Zealand law and is subject to (and must be read in conjunction with) our Website Terms and Conditions. In the event of any inconsistency between this Privacy Policy and our other applicable policies or our Website Terms and Conditions, the terms of this Privacy Policy will prevail. 

2) PERSONAL INFORMATION DEFINED

Personal information means any information that may identify a natural person, whether directly or indirectly.  It may include, but is not limited to:

  1. Your name, physical address, email address, telephone number

  2. Payment information

  3. Support queries and requests

  4. Photographic identification 

If you cannot be identified by the personal information collected (for example, when the information has been aggregated and anonymised) then this Privacy Policy does not apply to that information.  

3) COLLECTION OF PERSONAL INFORMATION

Your use of our Website, our services and attendance to any of our 100% Group stores may generate certain information that can be monitored and recorded electronically by us. This information may include personal information, for example, your name, addresses, phone number, payment information etc., and other general information for statistical and analytical purposes such as age, gender, mobile location data, IP address, product preferences, purchases and returns history. We use this information to operate and improve the site and the services we provide to you. 

Information about you and your visit may be collected by automated tools and methods (such as cookies, sessions and website statistics software) when you visit our Website. A cookie is a small text file placed on your computer's hard drive or browser by a webpage server. A cookie file contains anonymous details of your IP address, PC platform (Windows, Mac etc.), browser and domain (whether accessing from New Zealand or elsewhere). If you want to disable cookies, you may do so by changing the setting on your browser. However, if you disable cookies, you may not be able to use all the functions on our Website. 

If you choose to sign up with us, we may request additional information such as your billing address and credit card details. Additionally, you may subscribe to receive regular marketing emails from us. You can unsubscribe at any time by clicking the ‘unsubscribe’ link in any email you receive from us.

If you visit a 100% Group store, those stores may collect your personal information through their CCTV camera system or facial recognition technology, including your image and the number plate of your vehicle. 

Except for information collected automatically, we will not attempt to collect personal information about you without your knowledge. You may decide not to provide your personal information to us. However, you acknowledge that if you do not provide required personal information (or if you provide incorrect personal information), we might not be able to provide you with access to certain information, products or services including our online shopping service. 

We may collect personal information about you from a third party source where you have agreed to the release of such personal information to us.  

You must not provide personal information to us about another person, unless that person has authorised us, through you, to collect, use and disclose personal information about that person, for the purposes described in this Privacy Policy. 

4) WHY WE COLLECT PERSONAL INFORMATION

We collect personal information to provide you with, optimise and allow access to our Website, stores and services. We may use any of your Personal Information in the following ways:

  1. to provide our services and support services

  2. for communicating with you, including operational and marketing communications

  3. to verify a person’s identity

  4. to undertake credit checks (if we deem it necessary)

  5. to bill and collect money that our customers owe us, including authorising and processing credit card transactions

  6. to protect and/or enforce our legal rights and interests

  7. to enhance your experience of our services and assist with developing and improving our Website and services

  8. participate in competitions and promotions

  9. to publish any reviews or testimonials you give about us on our Website or social media

  10. undertake data analytics

  11. detect and prevent criminal behaviour and the safety of people in our stores

  12. in accordance with our legal obligations

  13. any other purpose authorised by the personal information it is, or by the Privacy Act.

5) DISCLOSURE OF PERSONAL INFORMATION

In order to properly provide our services, we may need to disclose your personal information to third parties, including:

  1. our staff

  2. other companies in the 100% Group

  3. third party service providers who assist and enable us to use personal information including our payment processing providers, marketing partners, and product delivery services

  4. to third parties to manage loss prevention, retail crime and property damage

  5. to such other persons that you may have agreed to provide your personal information to.

We may not disclose your personal information to third parties based overseas without your consent unless the jurisdiction of that third party provides similar safeguards to those in the Privacy Act. If HGS uses cloud-based servers located outside of New Zealand to store any of your information, then we need to include an explicit consent to disclosure to that third party server holder notwithstanding their jurisdiction may not have comparable safeguards. We will not otherwise disclose your Personal Information except in accordance with this Privacy Policy and the Privacy Act.

6) PROTECTION OF YOUR PERSONAL INFORMATION

We recognise that it is important for customers to retain their privacy and be satisfied that their information is protected when they take advantage of our services. Consequently, we use various security measures and follow privacy principles to protect your information from unauthorised disclosure and misuse, including:   

  1. Securing personal information both in physical and electronic form

  2. Limiting staff access to personal information only to those that need access to it for the purpose of providing you with our services

  3. Only providing personal information to the third parties outlined in this Privacy Policy who have agreed to treat the information confidentially

  4. Protecting our systems with appropriate technology.

As the internet is not a secure environment, we cannot guarantee that loss, misuse or alteration of personal information will not occur.  We will not be liable for any direct or indirect damage or loss for any unauthorised access or misuse of your personal information, but we will use our best efforts to prevent this. 

7) LEGAL DISCLAIMER

Though we make every effort to preserve user privacy, we may need to disclose personal information when required by law (for example, to comply with a current judicial proceeding, a court order or legal process, to protect and defend our rights) or to protect the personal safety of any individual or property. We will endeavour to inform you of this type of disclosure where possible and appropriate. You consent to the disclosure and use of your personal information in these circumstances. 

9) ACCESS AND CORRECTION 

Where we hold your personal information in such a way that it can readily be retrieved, in general, you will be entitled to access that information or obtain our confirmation of whether we hold such information. We may require that you meet our reasonable costs of supplying this information to you. 

If we cannot provide you with access to your personal information, we will provide you with the reasons why in accordance with the requirements of the Privacy Act. It is important to us that your personal information held by us is accurate, complete and current. Under the Privacy Act, you have rights to request correction of your personal information. If you are a registered user of our Website, you may also update your personal information under your account settings (functionality permitting).

10) STORAGE AND SECURITY 

Where we store your personal information will depend on the nature and purpose of the information and the manner in which you supply it to us. We will collect your Personal Information from, and may hold such information by using a cloud services provider (whether in New Zealand or overseas).

We will keep your personal information only for so long as is necessary to achieve the purpose we collected it for and in all cases for such periods as we are required to in order to comply with any relevant legislative or regulatory requirements.

10) CHANGES TO THIS POLICY 

We reserve the right, at our discretion, to modify or amend this Privacy Policy at any time. Changes to this Privacy Policy will take effect immediately once they are published on our Website.  If we make any significant changes to this Privacy Policy, we will (where possible) provide you will reasonable notice of such changes by email but we encourage you to check our Website regularly for updates. By continuing to use our Website or providing any personal information after we publish changes to this Privacy Policy, you agree to be bound by the amended Privacy Policy.
